Canadian Homeownership shall not be subject to any obligations of confidentiality regarding any information or materials that you submit online except as specified in these Terms of Use, or as set forth in any additional terms and conditions relating to specific products or services, or as otherwise specifically agreed or required by law.

The commercial use, reproduction, transmission or distribution of any information, software or other material available through the Website without the prior written consent of Canadian Homeownership is strictly prohibited.

All correspondence made by users (registered or not) via email or form submission is tracked and monitored by Canadian Homeownership. 7.  No Unlawful or Prohibited Use
As a condition of your use of the Site, you warrant to Canadian Homeownershipthat you will not use the Sitefor any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Sitein any manner that could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.

8.  Spamming

Gathering email addresses from Canadian Homeownership through harvesting or automated means is prohibited by users.  Posting or transmitting unauthorized or unsolicited advertising, promotional materials, or any other forms of solicitation to other Users is prohibited, this includes responding to postings and/or listings put on the Site by registered users. Similar to other commercial web sites, our web site utilizes a standard technology called "cookies" and web server logs to collect information about how our Site is used. Each time a visitor comes to the Canadian Homeownership Site, our web server collects visitor's domain name or IP address to protect the site from spamming.Inquiries regarding a commercial relationship with Canadian Homeownership should be directed to:Customer.Service@CanadianHomeownership.com.

Canadian Homeownership and the Site strictly forbids the use of our products and services in unsolicited commercial email (UCE) or SPAM campaigns. We maintain a Zero-Tolerance policy against SPAM, be it direct, third party or any affiliate or similar agent acting on the account holder’s behalf.

Spam is a common slang term referring to the sending of unsolicited email, instant messaging, or other communication to a large group of people at once. Variations on this practice include off topic (and usually promotional) messages to posters of listings that are not relevant to the listing or are sent to recruit business for the users own gain, messages on bulletin boards, or messages unrelated to topics being discussed in forums.

If you have received an unsolicited e-mail from Canadian Homeownership or as a result of using our Site for purposes other than to provide you with service on your property listing or wish list posting, we want to know.  Send any inquiries to Customer.Service@CanadianHomeownership.com.  Please include the entire original message, including the full headers of the spam that you received.  Our team will ensure that the problem is dealt with, and that your privacy is assured.

We consider the following to be a violation of this policy:

1.      Sending electronic communications to any contact that has posted a listing that is not related to their listing or is designed to take business away from the Site (i.e. defaming our services, recruiting the poster for your own gain, etc.).

2.      Disguising or otherwise obfuscating the nature of any URL or link from our system, or the purpose of any email sent through our service. 

3.      Using any CanadianHomeownership.com in any UCE from any source. 

4.      Sending UCE through CanadianHomeownership.com, or any third party, that directs the recipient to any website that links to CanadianHomeownership.com, utilizes any of our products or services or contains any URL relating back to the domains used by CanadianHomeownership.com.

5.      Spamming, or otherwise flooding newsgroups and forums with posts including any of our links or URLs, or posting links to any site that utilizes or references CanadianHomeownership.com.

 

Any user found to be involved in a SPAM/UCE campaign, involving the services provided by CanadianHomeownership.com in any capacity, including flooding other sites’ newsgroups with any information relating back to the products or services offered by the Site, distributing messages to recipients that have not specifically requested the information, or any other abuse of our system contravening CAN SPAM UCE legislation will be met as follows:

 

1.      The CanadianHomeownership.com account will be put on suspension and will be notified by our Customer Service Department that they are in violation of our Anti-Spam policy. 

2.      A $500.00 Canadian administration fee will be incurred against the offending CanadianHomeownership.comuser, regardless if they are registered or not.

3.      Our Privacy Policy becomes forfeit, and all pertinent information will be provided to any investigating authorities or anti-Spam organizations.

4.      If the user is a registered user of the Site, all information contained within the CanadianHomeownership.com’s account will be forfeit, with no consideration of retrieval.

 

9.  No Warranties

10.  Governing Law, Location and Miscellaneous

These Terms of Use shall be governed in all respects by the laws of the Province of Ontario, Canada, without reference to its choice of law rules. If an applicable law is in conflict with any part of the Terms of Use, the Terms of Use will be deemed modified to conform to the law. The other provisions will not be affected by any such modification.

11. Separate Agreements

You may have other agreements with Canadian Homeownership. Those agreements are separate and in addition to these Terms of Use. These Terms of Use do not modify, revise or amend the terms of any other agreements you may have with Canadian Homeownership.

12. Canadian Resident

You represent that you are a resident of Canada.

13. No Professional Advice

The information available on the Website is intended to be a general information resource regarding the matters covered, and is not tailored to your specific circumstance. You should not construe this as legal, accounting or other professional advice. This Website is not intended for use by minors. YOU SHOULD EVALUATE ALL INFORMATION, OPINIONS AND ADVICE AVAILABLE ON THIS WEBSITE IN CONSULTATION WITH YOUR INSURANCE SPECIALIST, OR WITH YOUR LEGAL, TAX, FINANCIAL OR OTHER ADVISOR, AS APPROPRIATE.

14. Users Disputes

You are solely responsible for your interactions with other Users. Canadian Homeownershipreserves the right, but has no obligation, to monitor disputes between you and other Users.

15. User Submissions and Communications; Public Areas:

Canadian Homeownership provides a variety of products and services to the public, including, but not limited for Buyers, Sellers, Optionors, Optionees, Renters, Landlords and Real Estate Investors.

Canadian Homeownership has created this Site to facilitate the exchange of ideas and of property listings in the dealings of real estate.Should you decide to become an optionee/tenant registered with the Site, you will be asked to submit descriptions of your ideal wants and needs through a form on the website.

You agree that any materials, including but not limited to wish lists, requirements, descriptions, questions, comments, suggestions, ideas, original or creative materials or other information, provided by you in the form of e-mail or submissions to us, or postings on the Site, are non-confidential (subject to our Privacy Policy). We will own exclusive rights, including all intellectual property rights, and will be entitled to the unrestricted use of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Anything you submit, whether through an application form, submission form, or as a response to a poster’s listing (property or wish list) ("Submissions") must comply with the following guidelines:

• Submissions cannot be sexually explicit or suggestive, violent, or derogatory of anyethnic, racial, gender, religious, professional or age group, profane or pornographic,contain nudity, or any materially dangerous activity;

• Submissions cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the useof any of the foregoing), any activities that may appear unsafe or dangerous, or anyparticular political agenda or message;

• Submissions cannot be obscene or offensive, endorse any form of hate or hate group;

• Submissions cannot defame, misrepresent or contain disparaging remarks about Canadian Homeownership or its products, or other people, products or companies;

• Unless otherwise permitted herein, submissions cannot contain trademarks, logos or tradedress owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, personal names, e-mail addresses or street addresses;

• Submissions cannot contain copyrighted materials owned by others without permission;

• identifying any person, living or dead, without permission;

• Submissions cannot communicate messages or images inconsistent with the positiveimages and/or goodwill to which Canadian Homeownership wishes to associate;

Our goal is to ensure a top-notch customer experience and keep any communications occurring through and as a result of using the Site on topic and relative to the service being rendered. This website is not the appropriate place to resolve issues, complaints or suggestions about individualsales and service experiences or our products. We will not post comments that fall into this category. 16. Arbitration

Except as regarding any action seeking equitable relief, including without limitation for the purpose of protecting any Canadian Homeownershipconfidential information and/or intellectual property rights, any controversy or claim arising out of or relating to these Terms of Use or this Site shall be settled by binding arbitration in accordance with the provisions, in effect at the time the proceedings begin, of the Commercial Arbitration Act. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be held in the province of Ontario.

All information relating to or disclosed by any party in connection with the arbitration of any disputes hereunder shall be treated by the parties, their representatives, and the arbitrator as proprietary business information. Such information shall not be disclosed by any party or their respective representatives without the prior written authorisation of the party furnishing such information. Such information shall not be disclosed by the arbitrator without the prior written authorisation of all parties. Each party shall bear the burden of its own counsel fees incurred in connection with any arbitration proceedings.

Judgment upon the award returned by the arbitrator may be entered in any court having jurisdiction over the parties or their assets or application of enforcement, as the case may be. Any award by the arbitrator shall be the sole and exclusive remedy of the parties. The parties hereby waive all rights to judicial review of the arbitrator's decision and any award contained therein.

CANADIAN HOMEOWNERSHIP SPECIFICALLY DISCLAIMS ANY LIABILITY, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH ACCESS TO, USE OF OR RELIANCE ON THE CONTENT (EVEN IF CANADIAN HOMEOWNERSHIP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) OR THAT ARISE IN CONNECTION WITH MISTAKES OR OMISSIONS IN, OR DELAYS IN TRANSMISSION OF, INFORMATION TO OR FROM THE USER, ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION OR DELIVERY, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORDS, PROGRAMS OR FILES, INTERRUPTIONS IN TELECOMMUNICATIONS CONNECTIONS TO THE WEBSITE OR VIRUSES, WHETHER CAUSED IN WHOLE OR IN PART BY NEGLIGENCE, ACTS OF GOD, TELECOMMUNICATIONS FAILURE, THEFT OR DESTRUCTION OF, OR UNAUTHORIZED ACCESS TO THE WEBSITE OR THE CONTENT. You agree to defend, indemnify, and hold Canadian Homeownership, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

B. ADDITIONAL TERMS APPLICABLE ONLY TO REGISTERED USERS

20. Accounts and Security

Canadian Homeownership does not warrant that the functions contained in the service provided by the Website will be uninterrupted or error-free, that defects will be corrected or that this service or the server that makes it available will be free of viruses or other harmful components.

As part of the registration process, each user will be assigned a password (“Password”) and Login Name (“Login Name”). You shall provide Canadian Homeownership with accurate, complete, and updated Account Information. Failure to do so shall constitute a breach of this Terms of Use, which may result in immediate termination of your Account.

You may not:

1.      select or use a Login Name of another person with the intent to impersonate that person;

2.      use a name subject to the rights of any other person without authorisation;
